Terms & Conditions

These Terms and Conditions (Terms) form a binding agreement between you and Zad Digital (contact: info@zaddigital.com), the operator of the SamajUnnati platform (SamajUnnati, Zad Digital, we, us, or our). They govern the SamajUnnati website, Android and iOS applications, APIs, family and friend tree tools, social feeds, stories, messaging, notifications, matrimony features, and related services (collectively, the Service).

When creating an account, you must affirmatively select the acceptance checkbox. We record the server time and the versions of the Terms and Privacy Policy accepted with your registration. Accessing the Service after registration also confirms your continuing agreement to the then-applicable Terms. Existing users may be asked to accept materially revised terms where required.

The Privacy Policy is incorporated into these Terms. If you do not understand or agree with these documents, do not register or use the Service.

You must be legally capable of entering into this agreement under applicable law. If you use the Service for or on behalf of a minor, dependent, or another person, you represent that you are legally authorized to do so and accept responsibility for their information and activity.

Matrimony functionality is intended only for adults who are legally eligible to marry. You must not create, manage, browse, or interact with a matrimony profile for a minor. Family trees may contain information about minors only where a parent or lawful guardian has authorized it and where the information is appropriate and necessary.

Successful SMS dispatch is not guaranteed because delivery depends on mobile networks and third-party providers. You must not request OTPs for a number you do not control.

• Accurate information: You must provide accurate, current, and complete registration and profile information and keep it updated.
• Phone verification: The Service uses one-time passwords (OTPs) sent by SMS for authentication and phone-number changes. Carrier messaging and data charges may apply.
• Credential security: OTPs, authentication tokens, and device access are confidential. You are responsible for activity conducted through your account unless you promptly notify us of unauthorized use.
• One person and account integrity: Do not impersonate another person, create deceptive identities, transfer accounts, or use another person’s phone number without authority.
• Abuse prevention: We may rate-limit, suspend, or block requests, devices, phone numbers, or accounts where we reasonably detect automated abuse, fraud, credential attacks, or security threats.

Profiles may include names, photos, banners, biography, date of birth, gender, blood group, religion, community, caste, subcaste, education, employment, marital or matrimonial status, address, pincode, area, WhatsApp number, language preferences, and other details you choose to provide. Some fields may be sensitive in your jurisdiction.

You control the accuracy of your own profile and should provide only information that is necessary and appropriate. Profile privacy controls affect some visibility, but they do not make every field or interaction private. Names, profile images, general profile details, relationship labels, posts, or matrimony information may be visible according to the feature and settings used.

• Authority and consent: Before adding a living person’s name, phone number, photograph, birth date, health-related detail, address, or other personal information, you must have a lawful basis and all permissions required from that person or their guardian.
• Unregistered profiles: Adding a relative or friend may create a limited record for a person who has not registered. You must not use this feature to build directories, scrape contacts, harass people, or process information without authority.
• Relationship accuracy: Relationship types, genealogy, custom names, photographs, and tree positions are user-submitted. SamajUnnati does not independently certify lineage or family claims.
• Approvals and visibility: Some living-person relationships require approval; other records, including certain user-created or deceased-person nodes, may appear without mutual approval. Visibility depends on relationship status, creator, category, settings, and feature behavior.
• Removal and unfollowing: Removing or hiding a relationship from your tree may not delete the other person’s profile, their tree, records created by others, historical audit data, or legally retained information.

If you grant contacts permission, the mobile app may let you select a contact and copy the selected name, phone number, and available photo into a relationship form. The Service is not intended to upload your entire address book automatically. You remain responsible for reviewing selected information and obtaining permission before submitting it.

If you grant location permission or provide a pincode, the Service may use your coordinates or postal code to identify an area through external geocoding or postal-data providers. Precise GPS coordinates used for lookup are not intended to be stored as a profile location, but the resulting pincode, locality, city, or area may be stored.

Camera, photo library, contacts, location, notification, microphone, and other permissions remain optional unless necessary for a feature you choose. You can manage permissions in device settings, although disabling them may limit functionality.

You retain ownership of content you lawfully create and upload, including profile media, tree information, posts, stories, captions, comments, messages, group information, documents, and other materials (User Content).

You grant SamajUnnati a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for technical formatting, transmit, cache, display, and distribute User Content solely as needed to operate, secure, improve, and provide the Service according to your actions, audience choices, and settings. This license ends when content is deleted from active systems, subject to backups, caches, shared copies, legal obligations, and content retained by other users.

You represent that you own or have permission to use and share User Content and that it does not violate privacy, publicity, intellectual-property, contractual, or other rights. You are responsible for recipients and audiences you select.

• Messaging: Messages and media are delivered to conversation members. Group administrators and permissions may control membership and capabilities. Do not assume messages are end-to-end encrypted unless the Service expressly states so.
• Disappearing messages: A disappearing or deleted message may be hidden or cleared from active display after a period, but copies may remain in backups, caches, notifications, device storage, screenshots, or another participant’s records.
• Stories: Stories may stop appearing after their expiry time; expiry does not necessarily mean immediate physical deletion from every storage system or cache.
• Push notifications: Notifications may include names, relationship activity, post activity, or message previews on a device lock screen. You are responsible for device notification settings and access.

Matrimony profiles, recommendations, interests, matches, shortlists, and compatibility or trust indicators are informational tools only. SamajUnnati does not guarantee identity, background, compatibility, marital status, family claims, safety, or the outcome of any communication or relationship.

You must independently verify a person and exercise appropriate caution before meeting, sharing sensitive information, transferring money, or making decisions. Never send funds or financial credentials to someone based solely on information from the Service.

If you create or manage a profile for another adult, you represent that the person has knowingly authorized you, the information is accurate, and your management complies with applicable law. The profile subject may claim or control their profile according to available functionality.

• Do not post unlawful, fraudulent, threatening, hateful, harassing, defamatory, sexually exploitative, violent, or privacy-invasive content.
• Do not impersonate others, fabricate relationships, publish another person’s sensitive information without authority, or misuse deceased-person records.
• Do not scrape, harvest, sell, or compile phone numbers, profiles, family graphs, messages, media, or community data.
• Do not spam, phish, distribute malware, probe security, reverse engineer protected systems, bypass access controls, automate accounts, or interfere with service availability.
• Do not upload content that infringes copyright, trademarks, publicity, database, confidentiality, or other rights.
• Do not use the Service for discrimination, unlawful surveillance, exploitation, trafficking, dowry demands, financial fraud, or other harmful conduct.

We may investigate reports and remove, restrict, preserve, or disclose content or account information where reasonably necessary to enforce these Terms, protect users, comply with law, respond to legal process, or address security and safety. We are not obligated to monitor all activity and cannot guarantee that objectionable content will never appear.

Enforcement may include warnings, feature restrictions, content removal, relationship removal, rate limits, temporary suspension, permanent account termination, or referral to authorities. We may act without prior notice where urgent risk, fraud, illegality, or security concerns exist.

The Service, software, interfaces, designs, branding, logos, documentation, databases, and non-user content are owned by or licensed to SamajUnnati and are protected by applicable laws. Subject to these Terms, you receive a limited, personal, revocable, non-transferable, non-exclusive license to use the Service for its intended purposes.

No right is granted to copy, resell, sublicense, create competing datasets from, or commercially exploit the Service except with prior written permission.

The Service may depend on mobile networks, app stores, hosting, databases, object storage, SMS, mapping, postal, media, music, notification, and authentication providers. Their terms and privacy practices may apply. We are not responsible for third-party availability, content, security, pricing, or decisions beyond our reasonable control.

Links, previews, or integrations do not imply endorsement. You should review third-party terms before using an integration or leaving the Service.

The Service may be updated, interrupted, suspended, limited, or discontinued. Features may be experimental, incomplete, or changed without guaranteeing backward compatibility. We do not guarantee uninterrupted access, preservation of every layout or relationship representation, or recovery of every item of User Content.

You should maintain your own copies of important photographs, documents, genealogy, and communications. Scheduled maintenance, network failures, force majeure, abuse prevention, and third-party outages may affect availability.

Unless a feature is expressly identified as paid, current access may be offered without a separate platform fee. We may introduce paid features, subscriptions, promotions, taxes, or transaction terms in the future. Applicable pricing and cancellation terms will be presented before purchase. Carrier, internet, and third-party charges remain your responsibility.

You may stop using the Service and may request account closure through the contact method in the Privacy Policy. We may suspend or terminate access for violation of these Terms, legal requirements, security risks, prolonged inactivity, fraud, or discontinuation of the Service.

Termination does not automatically erase content shared with others, relationship records created by others, legal records, fraud-prevention data, backups, or information we must retain. Provisions concerning licenses, liability, disputes, enforcement, and accrued obligations survive where applicable.

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, identity verification, family-lineage correctness, matrimonial compatibility, and content reliability.

SamajUnnati is a technology platform, not a genealogical authority, matrimonial broker, background-check agency, medical service, legal adviser, emergency service, or guarantor of user conduct. Information such as blood group, age, relationship, trust, and compatibility must not be relied on as professional or independently verified advice.

To the maximum extent permitted by law, SamajUnnati and its operators, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, reputation, opportunity, revenue, or relationships; or harm caused by users, meetings, content, communications, unauthorized access, or third-party services.

Nothing in these Terms excludes liability that cannot lawfully be excluded. You agree to defend, indemnify, and hold harmless SamajUnnati from claims, losses, and expenses arising from your unlawful use, User Content, information submitted about others, infringement, fraud, or breach of these Terms, to the extent permitted by law.

These Terms are intended to operate under applicable laws of India, including mandatory consumer and data-protection requirements. Before filing a formal claim, you and SamajUnnati should attempt in good faith to resolve the issue through info@zaddigital.com.

Subject to mandatory law, disputes will be brought before courts of competent jurisdiction in India.

We may revise these Terms to reflect feature, legal, security, or operational changes. The effective date and version will be updated on this page. Where a change is material, we may provide notice in the Service or require renewed acceptance. Continued use after the effective date may constitute acceptance where permitted by law.

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a restructuring, financing, acquisition, or transfer of the Service, subject to applicable law.

These Terms and the Privacy Policy form the entire agreement concerning the Service unless additional feature-specific terms are presented. Headings are for convenience and do not limit interpretation.

Questions, complaints, takedown requests, safety reports, and legal notices may be sent to info@zaddigital.com. Include enough detail for us to identify the account, content, or request, but do not email OTPs, passwords, financial credentials, or unnecessary sensitive information.
